ถ้าเป้าหมายของคุณคือการเรียนต่อกฎหมายที่ สหราชอาณาจักร (UK) แล้ววันหนึ่งอยากกลับมาสอบเป็น ผู้ช่วยผู้พิพากษา หรือ อัยการผู้ช่วย มีเรื่องหนึ่งที่สำคัญกว่าชื่อเสียงของมหาวิทยาลัยเสียอีก นั่นคือ “หลักสูตรที่เราจะเรียนต้องอยู่ในรายชื่อที่ ก.ต. ให้ความเห็นชอบแล้ว”
เพราะต่อให้จบจากมหาวิทยาลัยอันดับต้น ๆ ของโลก แต่ถ้าชื่อหลักสูตรไม่ตรงกับที่ประกาศไว้ ก็อาจต้องเสียเวลายื่นขอรับรองเพิ่มเติม หรือแย่กว่านั้นคือใช้เป็นคุณสมบัติสมัครสอบไม่ได้เลย บทความนี้จะพาไปรู้จักว่า “ก.ต.” คือใคร ทำไมต้องเช็กเรื่องนี้ก่อนตัดสินใจเรียนต่อ พร้อมสรุปรายชื่อมหาวิทยาลัยและหลักสูตรในสหราชอาณาจักรที่ผ่านความเห็นชอบแล้ว และวิธีตรวจสอบให้ชัวร์ก่อนสมัครเรียนจริง
ก.ต. คือใคร แล้วเกี่ยวอะไรกับคนที่จะเรียนต่ออังกฤษ
ก.ต. ย่อมาจาก คณะกรรมการตุลาการศาลยุติธรรม ซึ่งมีสำนักงานคือ สำนักคณะกรรมการตุลาการศาลยุติธรรม (Office of the Judicial Commission) ทำหน้าที่ดูแลเรื่องคุณสมบัติของผู้ที่จะเข้าสู่เส้นทางตุลาการ หนึ่งในนั้นคือการกำหนดว่า ปริญญาทางกฎหมายจากต่างประเทศ ใบไหนบ้างที่ใช้เป็นคุณสมบัติสมัครสอบผู้ช่วยผู้พิพากษาได้ (คนที่เรียนสายกฎหมายมักเรียกกันติดปากว่า “สนามจิ๋ว”)
พูดง่าย ๆ คือ ถ้าอยากเรียนกฎหมายที่อังกฤษแล้วหวังจะใช้วุฒิไปสอบเป็นผู้พิพากษาหรืออัยการในอนาคต หลักสูตรที่เรียนจะต้อง ตรงกับรายชื่อที่ ก.ต. เห็นชอบแล้วเท่านั้น ถึงจะนับเป็นคุณสมบัติได้ครบถ้วนตามระเบียบ
การรับรองหลักสูตรมี 2 แบบ ต่างกันอย่างไร
จากการอ่านหลักเกณฑ์ของ ก.ต. แบบง่าย ๆ การรับรองหลักสูตรกฎหมายจากต่างประเทศแบ่งออกเป็น 2 กลุ่มหลัก ๆ คือ
- หลักสูตรทั่วไป คือปริญญาทางกฎหมายระดับปกติ เช่น LL.M. (Master of Laws) แบบทั่วไปที่ไม่ได้เจาะจงสาขาย่อยเป็นพิเศษ ใช้เป็นคุณสมบัติพื้นฐานในการสมัครสอบได้
- หลักสูตรเฉพาะด้าน ตามข้อ 12 วรรคสอง (1) คือ LL.M. ที่เจาะลึกเฉพาะสาขา เช่น กฎหมายทรัพย์สินทางปัญญา กฎหมายภาษี กฎหมายการเงินระหว่างประเทศ ฯลฯ ซึ่งใช้ทดแทนคุณสมบัติเฉพาะบางข้อได้ แต่เงื่อนไขจะต่างจากหลักสูตรทั่วไป
สิ่งที่คนส่วนใหญ่พลาดคือคิดว่า “มหาวิทยาลัยนี้อยู่ในลิสต์ ก.ต. แล้ว เรียนหลักสูตรไหนก็ได้ที่นั่น” ซึ่งไม่ถูกต้อง เพราะ ก.ต. รับรอง เป็นรายหลักสูตร ไม่ใช่รายมหาวิทยาลัย บางมหาวิทยาลัยมีหลายหลักสูตร แต่ผ่านการรับรองแค่บางหลักสูตรเท่านั้น

- เปิดเช็กไฟล์ล่าสุดจากเว็บ ก.ต. โดยตรงเสมอ รายชื่อนี้มีการอัปเดตเป็นระยะ บทความนี้รวบรวมจากประกาศฉบับล่าสุดที่เผยแพร่ไว้ แต่แนะนำให้เปิดดูไฟล์ต้นฉบับอีกครั้งก่อนตัดสินใจจริง ผ่านหน้าเว็บของสำนักคณะกรรมการตุลาการศาลยุติธรรม (คลิกดูรายชื่อฉบับทางการที่นี่)
- เทียบชื่อหลักสูตรให้ตรงตัวอักษร ก.ต. รับรองตามชื่อหลักสูตรที่ประกาศไว้เป๊ะ ๆ ถ้ามหาวิทยาลัยตั้งชื่อหลักสูตรต่างจากในลิสต์แม้แต่นิดเดียว ก็อาจถือว่าไม่ใช่หลักสูตรเดียวกัน ควรขอชื่อหลักสูตรแบบเต็มจากมหาวิทยาลัยมาเทียบให้ตรงก่อนสมัคร
- ระวังหลักสูตรที่เปลี่ยนชื่อ บางมหาวิทยาลัยปรับปรุงหลักสูตรและเปลี่ยนชื่อใหม่ตามยุคสมัย ถ้าชื่อในใบปริญญาไม่ตรงกับชื่อที่เคยได้รับความเห็นชอบ ควรสอบถาม ก.ต. ล่วงหน้าว่านับเป็นหลักสูตรเดิมหรือไม่ เพื่อไม่ให้เสียเวลาหลังเรียนจบไปแล้ว
- ถ้าหลักสูตรที่อยากเรียนยังไม่มีในลิสต์ ไม่ได้แปลว่าหมดสิทธิ์ สามารถยื่นเรื่องขอให้ ก.ต. พิจารณาให้ความเห็นชอบหลักสูตรเพิ่มเติมได้ ซึ่งใช้เวลาพิจารณาระยะหนึ่ง จึงควรเผื่อเวลาวางแผนล่วงหน้าให้ดี
- ปรึกษาคนที่มีประสบการณ์ตรงก่อนสมัคร เพราะรายละเอียดปลีกย่อยเรื่องชื่อหลักสูตร ปีที่ประกาศ หรือเงื่อนไขเฉพาะของแต่ละมหาวิทยาลัยค่อนข้างซับซ้อน การคุยกับที่ปรึกษาด้านเรียนต่อที่เข้าใจเรื่องนี้จะช่วยลดความเสี่ยงเรื่องเลือกหลักสูตรผิดได้มาก

การเรียนกฎหมายที่อังกฤษเพื่อเก็บสะสมคุณสมบัติสอบผู้ช่วยผู้พิพากษาหรืออัยการ ไม่ใช่แค่เลือกมหาวิทยาลัยที่มีชื่อเสียงแล้วจบ แต่ต้องดูให้ลึกถึงระดับ “ชื่อหลักสูตร” ว่าตรงกับที่ ก.ต. ประกาศไว้หรือเปล่า และควรเช็กจากแหล่งข้อมูลทางการอยู่เสมอ เพราะรายชื่อมีการปรับปรุงอยู่เรื่อย ๆ
